Consumer Credit Act Section 75

Your credit card can be misused and there can be other issues that arise.  If you have issues you need to know what the liability is to you for that card.  Under the consumer credit act you are covered for certain issues.  With the act, if the card has been misused in some way and you are entitled to compensation, you can withhold that amount from your next payment.  There is of course an easier way to go about getting the compensation.  Diner’s Club and American Express are not covered by the Section 75, but all others are.

A credit card company can be liable if the cash price of goods or services are over 100 pounds and under 30,000 pounds.  You must file a claim for breach of contract against the supplier for the goods or services.  If the claim is satisfactory the credit card company will then issue a refund.

It is best to deal directly with the supplier first.  In some cases it could be a mistake that was made.  By allowing the supplier to fix it they will not have a claim filed against them for acts of wrongdoing when it was a mistake.  However, if they are uncooperative, meaning they don’t take your claim seriously or they are not a trustworthy company, you can file the claim with the credit card company.

You must make sure that the claim you are filing is valid.  So establish the worth of the item and then write the credit company with a detailed account of the dispute you have.  You will also need to enclose evidence in the written account.  The letter should state the funds you will not be paying and should be credited.

In some cases you will get a negative response from the credit card company.  Just stay with the issue until you get the correct answer.  Credit card companies tend to work on the side of the customer in the end.

If you are making a large purchase you might want to look into the method of purchase.  Some companies will give a discount if you use a cheque rather than a credit card.  You will also save on interest charges if you don’t use a credit card.

Payments that are made by card will give you protection, which is very helpful and something a cheque can’t always offer.

You need to keep copies of your credit card accounts so that you have proof of payment and the price.  This can help your claim.

You need to pursue the claims with the supplier as they are responsible.

If the credit card company has not issued a refund or the company will not do so, you must be able to establish the claim completely by explaining why and what happened.

The valid claims will eventually win out.  Some companies refuse in the hopes that you will not keep on top of the claim, but those who do will get the money back as per the consumer credit act requirements.
